Correct. They are arbitrators seeking to find a fair and equitable solution to a dispute. One in which a set of rules, and they way they have been interpreted, will both be analysed. They won’t just say because UEFA wrote them only they can decide on their application.

It's a start but distinguishing a German lady from a New Wave band hardly makes him A.J.P.Taylor.
 
This is an interesting point because a lot of this thread has assumed the burden of proof is with Palace. I don't know either way, but it would make sense that UEFA should have to prove we violated the rules.
On appeal burden of proof shifts to the appellant.

UEFA applied wrong rules or right rules wrongly.

A party properly advised will not submit an appeal unless they believed the merits were with them.

In our case, Textor did not, as a fact have decisive control of our club. Appeal wins. Whatever interest he had at Lyon and whatever is happening at Forest is neither here nor there.
 
Some have posted that Lyon and or Forest may get sanction by CAS. I don't think that will happen.

CAS may criticise them but it is up to UEFA to decide punishment.

Best case for us is that we win and CAS slag off UEFA and Forest and Lyon.
 
Regardless of the outcome I think UEFA has jumped the gun . We had to wait for the Lyon appeal process to play out before UEFA made a decision on their status as a competing club . The same courtesy should have been given to us . All they had to do was suggest we would be demoted to the conference subject to appeal not go charging in , demote us and install another club in our place .

What could have been a simple you're in or out now has the added influence of a third party .Its a mess of Uefa's own making .

Good question. Apparently, despite Blitzer having the same percentage of voting shares as Textor, UEFA’s rules are as elastic as a bungee cord, when it suits them!
