It could well be that any appeal to CAS will fail.
But it's still a fight worth having in my opinion. If only to highlight UEFA's governance failures. And, worse still, their corruption. I found these statements ;
In April 2023, one senior football figure came out with the following: “There are clubs - or at least one - where we still pretend it’s not the same owner [as another club] but it’s the same owner, and I will not tell you which. You can guess.”
“Pretend” is quite a word to use. And this was no less an individual than the most senior figure in European football: Uefa president Aleksander Ceferin.
and ;
Former Uefa executive Alex Phillips even said the following for this writer’s book, ‘States of Play’:“It’s never the biggest clubs… a settlement to clubs with unlimited money is great because the only thing they fear is exclusion. The simple fact that Uefa is also the organiser of the Champions League means they have an interest in preserving teams like PSG and City.”
They make the rules, but also make the money off the competitions.
As events have unfolded, it seems - and this is just my opinion - that a notification of the deadline change for evading the MCO rule was sent to Palace. But no action was taken. Why not ? It appears that the club considered themselves not to be part of an MCO. Should they have taken steps to have that legally validated ? - with hindsight, yes.
The sticking points then become around what actions could be taken from October onwards. Parish could not force Textor to place his shares into a Blind Trust. He could of course have asked him to, but the counter argument to that is why should he ? Apart from moving an arbritary date from 1/6 to 1/3, what had changed ? The rules were ( presumably ) the same the season before excepting that deadline date. So clubs that may be exposed then have a window to take action. Maranakis did it because Forest were in a decent chance of CL football. And are definitely part of an MCO. Palace didn't do it because apart from not considering themselves part of a MCO, they had only just got through rounds 3 and 4 of the FA Cup.
Another alternative is for Textor to sell his shares. Well, he'd been trying to for months - because he didn't have the level of influence he wanted at the club despite his shareholding.
Hindsight's a wonderful thing, but maybe a better approach to all this was to admit to missing the 1/3 deadline and then articulating the reasons why. Without claiming non receipt of emails etc.
Because we are now in a situation whereby we meet UEFA's requirements. And with weeks to spare before a ball is kicked.
