Palace potentially denied entry to Europa League?

Given the apparent treachery of Notts Forest owner Marinakis wouldn't it be lovely if he tried to stitch us buying up all those expensive players and was then reduced back to the conference league (the thing Forest actually earned) and ultimately ended up in breach of PSR and facing fines and further challenges.

Frankly it's what he deserves given the hassle he's caused Parish and co. Nothing against Forest fans but their owner is a piece of work. Digging in to his alleged history doesn't make for good reading either.

If Forest go into the Europa in our place I don't anticipate Marinakis getting an invitation from Parish into the Director's Box in a few weeks ( assuming he even turns up).
 

If that's the argument then book a Scandinavian hotel.

CAS overturning a decision because it violates the 'fair play' statute would open a can of worms that would drown CAS in litigation for years and years. It's also entirely subjective which means they don't need to do it.

The best argument in an appeal is always that someone made the original decision on a) the wrong facts, or b) the wrong interpretation of the facts. A 2 hour slam dunk on how Textor didn't have decisive control could be persuasive. Dribbling on about what Barcelona say to the press won't do anything.

If we do end up in the Conference League, all I hope for is that people - and especially the club - cheer the f*** up and get on with it.

Yes, it would've been great to take on Roma, Porto, perhaps Celtic and whoever else drops in. Not getting the Europa League sucks. Unfortunately, there's a chance that a week from now no-one outside of SE25 will give a toss about what happened.

At the minimum we will still have a - maybe to never happen again - chance to take on Anderlecht, Fiorentina, Besiktas and maybe even with a bit of luck win a European trophy and have back to back European campaigns.

If we don't make the most of that then all we're doing is spiting ourselves.
 
Sky are reporting that Palace believe we have "compelling evidence" in the form of legal documents (which Sky have seen) saying the deadline wasn't 1 March but 30 April. Not sure what difference that makes as we still hadn't qualified then.

Yeah I agree.

At some point we will might have to accept whatever the reality is and get on with the season.

Either way, there looks to be very much a PL and European Season to be dealing with so I wish we’d get on with our transfer business too.

I understand that Palace are claiming that Marinakis didn’t adhere to the 1/3 deadline , which is the “ compelling evidence “

I think they mean it was extended for Forest to 30 April (as the blind trust was perfected by registration at Companies House on 29 April) meaning either:

1. It was extendable, not fixed, but would have required a request to extend; or
2. It was extendable by UEFAs own motion based on the facts before it.

If 1, and Forest can prove they applied to extend, were granted that extension and complied within the time granted, this helps us not.

If 2, then the deadline cannot be applied for one and not for another and is effectively reduced to a guideline only, at best. That probably helps us.

I suggest the club will do what you suggest for the reasons you give. However, it may argue the fairness point by tacking it on to the real points of substance.

The Europeans have form for this. Take the ECHR. There is a seemingly catch-all article on discrimination. However, it can only be used as parasitic to the main articles. Thus, you can raise it as discrimination on free speech, but not as a stand alone argument.

In our case, we did all we reasonably could to avoid an MCO, there was actually insufficient decisive control by Textor AND it would breach fair play to suggest otherwise given all the surrounding facts.
