Palace potentially denied entry to Europa League?

"Are appeals to CAS usually successful?"

UEFA know this.
The last time I can recall UEFA trying to go this big on a club was when they tried to kick City out of Europe for 2 years for FFP discrepancies and CAS overturned that - partly because UEFA couldn't fully prove the breaches. City were a lot more guilty of that breach than we are too.

At the point we won the FA cup, we were in default due to Textor’s dual shareholding. At the point Lyon achieved their final league position they were provisionally in Ligue 2 (punishment handed out in November 2024). So they were in default too. This is confirmed by this relegation being confirmed by the French football association. Lyon won their appeal presumably by injection of cash. So if they satisfied the authorities afterwards why can’t Textor’s share sale post fa cup win also count and allow us into the Europa League?

Looking at the positives... no-one cares much for the Conference League so Palace can use it as a series of competitive friendlies and give the squad players a game and rest the stars (until the knockout phase). Keeps the squad happy and doesn't hinder our league performance. Assuming we don't see more than 1 of our stars leaving in the summer we have a very good first team so should be looking to try and finish inside the top 10.
We still get a chance to watch the team in Europe. The teams we play wont be as good but some of the teams in the Europa league are awful too. The prize money is half the Europa but winning it gets you 20 million, not to be sniffed at. More chance of winning the Conference league with only a handful of decent clubs in it. Ultimately we won the FA Cup and Europe was just a bonus.

The rules suck and other clubs cheat their way round them (Red Bull etc) but in the end we can't complain if we don't abide by them. Its like complaining because the police arrested you from stealing when another bloke get let off.

I can’t see many positives.
I don’t really want to go to some 5000 capacity stadium in an Eastern European equivalent of Scunthorpe to win 5-0. It will be pointless and could ruin our season.
Gives the squad players e.g Nketiah, . Esse, Franca, Devenney etc. a chance to get regular starts. If West Ham, and Chelsea, in a canter, can win it then so should Palace. That would give Palace a trophy and entry to the Europa in 2026/7

Being a cynic, given we thought UEFA were looking for an easy scapegoat with Lyon, any chance they see CAS as an alternative easy scapegoat? Sorry Mr Macarenas, it wasn't our decision. And no, you can't have your brown envelope back.
This is quite possible I would think. UEFA appear to have made a decision, or have they? As it’s reported they have told Palace to go to CAS.
The thing is I doubt they have had this exact problem before, a late unexpected major cup winner, claims its ownership model doesn’t break their rules when in some respects it does. So why not let CAS decide.

Gutted for the players and manager. The best thing about being in the Europa was the possibility we might keep our best players and/or sign some decent ones on the back of it. What happens on that front is key to our season. Either way I hope we don’t fold and sell our stars in the cheap. Also likely to impact on the chance of persuading Ollie to sign on for a while longer.
On the other hand, it might encourage Guehi to move now to a Champions League club for a fee (and a much higher salary) rather than run down his contract and provide nothing for Palace's coffers

UEFA must explain how Citeh and Girona both got away with playing Champions League last season as prima facie, this looks an identical case. I'd be interested to hear why it is not.
That said, and this will not be popular, but this is a forum for discussion as well as for venting angst, we broke the rules. Or to put it another way, it's instructive that John Textor realized, as we were celebrating the win at Wembley (and even this ruling can't take away the thrill of having been there) that there was a problem. If you take the man's coin, you have to take the consequences.

spot on - the fat lady is still in the wings, if the FA can speed up confirming Texter's sale we must have a chance of getting back to the EL based on that logic - must treat both clubs retrospectively, although Lyon were in breach of French rules not UEFA's, that's the tricky bit but there must be enough wriggle room all things considered.

That's exactly what's been going around my head for the last hour or so. I wonder if Forest can go to CAS if we win our appeal?

I think we all know UEFA are a bunch of dickless cucks, but are they also that smart? 🤔

Different organizations ruling on the issue

Because we're Warwick Davis and they're Andre the Giant

One question, one comment.
Question: How come we can still play in the Conference League given Textor's stake in Bronby? Have Bronby been banished from that competition so we can take part?
Comment: This decision by UEFA seems to my (non-legally qualified) mind to be a classic example of 'indirect discrimination'. No way Palace could realistically have known at end of March that they should be putting Textor's shares into a trust. Yes, we broke UEFA's rule, but we've met the spirit of the rule by Textor selling up, and the rule is itself discriminatory against small clubs that unexpectedly qualify for European competition. Liverpool, City, Chelsea are in every year - they knew in March they would need to manipulate things to meet these rules. I think our appeal will succeed if natural justice still means anything.

Clearly the club do not believe we transgressed the rules hence the appeal to CAS.
