Palace potentially denied entry to Europa League?

Stephan Borson, who basically said we've got no chance, the FA sent out a memo in the autumn informing all prem clubs of the UEFA rule changes to prepare, arguing against the deadline won't work, some Slovak team just found that out, we'd have to convince them that Textor had zero influence before March 1 - that bit of paper that appeared a couple of weeks ago saying he had no say in running matters is our best chance apparently. But that document reminds of the suicide note that Joan Greenwood magically found at the end of Kind Hearts and Coronets to save Dennis Price from the noose if you like your Ealing Comedies.
I think I’d be using the articles of how our club is run and administered as proof rather than a bit of paper from Textor. Just drag him in as a witness if needs be.

As someone else has mentioned there may be some conflict between UK company law and the law under which UEFA operates. We can clearly show that Textor had NO decisive influence and he will back that up.

The whole thing is a sham to get Lyon and Forest in and Palace out, it’s truly shocking.
 
Needless to say we are all trying to figure out what is going on, and if I make a mistake I am the first to own up to it. And bear in mind, I was the one to point out my own error.

The first email was forwarded on by the FA to all club secretaries back in October 2024. I simply do not believe this was the first email sent by UEFA that came to the attention of Steve Parish. It then begs the question, what is the role of the club secretary in relation to this type of email? It must surely be to forward it on to the directors, with their own comments added. That’s what should have happened and no doubt that’s what did happen.

Then we fast forward to this info@cpfc.co.uk situation. Why did UEFA feel the need to use this account after having sent their initial change of policy notification to the club secretaries? Why was the same email then resent then sent again? Clearly, this was done out of an escalating sense of urgency, which none of the directors felt they needed to respond to or take any action on, and they were undoubtedly wrong in doing nothing. No, we are not an MCO club, but there are MCO issues that needed to be addressed and clarified.

You have never once accepted the validity of my assertion that John Textor, in particular, should have utilised the services of the ECA: why is that? What is so unreasonable about that assertion?

Both John Textor and David Blitzer had ample time to make up their minds as to what they intended to do, which should have been based upon a definitive understanding of what would be the possible consequences if they do not place their shares into a blind trust.

And this is not about crystal ball gazing, this is about the need to secure your business assets against potential risk, if you wish to retain those assets within an increasingly hostile environment for MCOs.

I have always maintained that this failure goes to the very heart of the case against Palace. If they had done this, the onus is then on UEFA to declare their intentions through the appropriate channels. But by not having that dialogue Palace left themselves vulnerable and ripe for exploitation by unscrupulous parties.
How do you know that behind closed doors Parish (and possibly Harris and Blitzer too) approached Textor about this very issue earlier in the season? They may have asked him to place his shares in a blind trust and he may have said no because he felt he was close to either a buyer for them or the flip side is he may have at that time not given up hope of buying Blitzer and Harris out.
They may then have asked him to at least show UEFA that he has no control at Palace and that this club is not part of his MCO group. Again (whether we agree or not is irrelevant) he may have said no. He felt the club were never going to win the cup, were never going to finish top 7 and even if that miracle happened he didn't believe Lyon would qualify for ANYTHING because even way back nearly a year ago they had a relegation hanging over them.

This comes back to the same thing. Regardless of what concerns Parish, Blitzer or Harris may or may not have had months ago they had no power to do anything about it. This has always been 100% Textor's problem to solve. You cant even blame the other owners for 'letting the wolf in the door' because Textor didn't own any other football club until AFTER he had invested in Palace. He wasn't a MCO at that time.
 
UEFA's stance is totally based around their share ownership rules. So no amount of proof that Textor had no decisive influence, of which there must be plenty, is going to make them shift their position.

Having an arbitrary deadline of March 1st for their rule evasion makes no sense given that their competitions don't start for another 5 months after that date.

If common sense was to prevail here, which I think is what Steve Parish is rather optimistically hoping for, UEFA could agree that the only real transgression in all this is a missed date.

In which case I don't think the punishment fits the crime. Especially when it is rumoured that UEFA are now looking at amending their rules in light of recent events.
I'd be surprised if they did that before the CAS hearing. Doing so only gives Palace more ammunition. Doesn't look good on them in court does it? When the very rule they are arguing about they themselves have conveniently decided to change!

They might have done but, if so, they should have obtained a paper trail. A brief comment over a coffee won't wash

Another investigative journo confirms what we already knew. It’s rather concerning that the jerk who put together the idea of blind trusts has more than a passing resemblance to Sadiq Khan. It’s a bloody conspiracy I tell you😡😂
 
He seemed very pessimistic about Palace's chances. I disagree with him on a few points such as 'they're better off in the Conference League anyway' bit pompous and dismissive of the fact we have earned the right to be in the EL as a consequence of winning the FA cup.
Funny how they write us off, yet we spent all season thrashing Spurs and Utd.

Borson said correctly that the idea of Textor being a 100% silent partner is nonsense - there was common share ownership on March 1, compliance instructions were sent by UEFA and the FA well in advance and we simply did not comply. We were sadly not expectant enough of European qualification to get our house in order in time, you can complain about the hoops but if you don't jump through them in time you lose - simples. We can only plea that we thought we were compliant (but weren't) and became compliant once we were told what steps needed to be taken - it's basically a plea for clemency which is unlikely to succeed. It maybe that Textor selling his shares has actually backfired when it should have helped us, but that logic seemingly has no effect legally. I'm starting to accept the Conference League situation, and it may work in our favour, though I did fancy an away day at one of the more glamourous clubs than the Athletico Arsendofbeyonds we will be going to.

Doubt CAS have any power to compel attendance.
