A judge being found to have erred in law! Who’d have thought it, another ridiculous decision that will have cost thousands to appeal. Oh sorry it’s only the Sun so can’t possibly be trye

He sounds like a seriously nasty piece of work who ought not be allowed anywhere near us. That said you cannot blame any Judge who tries to apply the law in good faith only to find an appeal court disagrees with them. The appeal decision now exists to guide future judgements.

If this kind of obviously undesirable outcome is to be avoided in future the responsibility rests with politicians not Judges. The law needs to be amended to ensure that those who genuinely need protection get it whilst those exploiting the law cannot.

This is why appeal courts are there Spider. It’s quite a good system. There’s 7 levels (I think) depending on what it is to make sure the right decision by law is made.

The UK legal system is still upheld by most of the world as one of the best. People should trust it.

I know, my comment related to a previous discussion with Wissie. I have had my fair share of experiences with appeals. Not criminal courts but the appellate authorities responsible for Immigration. If only I could tell, some on here would appreciate why I have little faith in their decision making

I too once appealed a decision made by Home Office officials which was grossly unreasonable and biased. It took 6 months to be heard but was won, with the Judge having some scolding words to say to the officers. I was awarded costs too but more than 10 years later haven’t seen a penny. I am not an Albanian gangster.
 
Every time the wind blows towards France the government (both Labour and Tory) have claimed that the boat numbers are down because their policies are working and nothing to do with the weather.

Hang on I just had a great idea. Why not build offshore wind farms on the south coast it will solve 2 problems at once. Ed Milliband where are you 😀

So do the right thing and inform the Authorities fined, just let them go no fine.

They can either a) dob him in to the authorities, after having shuttled him across the border at Dover ? or b) bung him a fiver and point him in the direction of the local kids school ? its a sick joke and nobody is laughing anymore.
 
The woman has just been interviewed on the radio. She said the car was searched at every border crossing prior to departing France. If the same thing happened again, she said they'd just let the bloke go. That is forming part of their appeal against the fine, is that there wouldn't be an incentive to report stowaways if people were fined for it.

will those heat-cameras also work for 'Curry colleges' ? sham-colleges that provide sham-courses to sham-students ? And all just to get a residency permit.

You need not worry about little dinghies landing on our beaches when there is a legal-tide flowing through our airports.

Whilst there certainly used to be bogus colleges the government introduced new measures that closed them down some years ago. So I don’t think they exist today.

The Home Office says the fine not about guilt, and they have a point.

If you accept the excuse "I didn't know" then all the wrong uns will use it and you would have to prove that they did know which I imagine would be very hard.

It's a deterrent and hopefully holidaymakers will look a bit more closely when coming home.

That said I do feel sorry for them.

I cannot remember the term, but there is the same rule of thumb in building / contractor trades.
If you have an accident, endanger life etc '' I didnt know'' will not save you from prosecution.
The lending of equipment /plant to others is particularly risky, putting ones head in a noose if they hurt themselves with you kit.
