Palace potentially denied entry to Europa League?

My guess is Palace have already appealed with detailed grounds sent today. I think hearing will be Friday or Monday.

We have I suspect a number of grounds.
1) we are not and never been party to a MCO and UEFA have no grounds in Law to consider we were. Then the arguments against the UEFA rules which any decent legal mind can rip apart.
2) Is the date of 1st of March set in stone? The memo and Forest's breach
3)The practicality of this date when leagues and cups are not finished? The only way any club with any owners who own shares in any other club can comply is blind trust shares by 1st March irrespective of European qualification. This is clearly ridiculous so rule can not stand test of common law.
4)The rules clearly state blind trust must last till after completion of European competitions. No where does it say you can revoke if you don't qualify.
5) The disclosure of Forest memos and anything that shows.
6) Are Eagle Football and Forest a MCO ? Sales /Loans between Eagle Football Clubs and Forest. Forest owner owning shares in Botafago.
7) Lyon qualified for Europa as a result of 2 very unexpected results. Is this potentially suspicious?
8) The penalty CPFC have been given is grossly excessive in any event. It would make much more sense to seperate CPFC and Lyon in League phase to remove any suggestion of bias on results. No professional side will "throw" a match in knock out phase.
9)precedent of other decisions.
On rulings on date sides had qualified on 1st March so rules were possible
CAS has previously ruled on excessive nature of UEFA decisions and reduced penalty. This is another example where penalty exceeds any perceived crime
10) Leave of court to apply for damages as a result of this unfair judgement. Football now works on a system of FFP or subsequent changes. In essence the uncertainty for CPFC in regard to European competitions finance has prevented player recruitment and retention.

What a mess UEFA made. An incompetent organisation.
This is all it boils down to in the end.

If UEFA had just said Palace were in the wrong, but slapped wrist, the affairs are now in order and off you go to compete nobody except perhaps Marinakis would have cared. But by baring Palace from entering all they have done is highlight their own ineptitude and brought about serious suggestions of corruption. It's a complete farce.

I keep writing a second paragraph then deleting it. I think I don't need to write anything more. You can all see how f***ing ridiculous that is.
 
There’s been some discussion on here about negotiation strategy.
I think our objectives should be,

1) Full reinstatement for Palace in the Europa, with a further season thrown in for free in recognition of the duress suffered by the club with the confected UEFA case

2) Forest compelled to give Gibbs White to Palace for free with the Forest owner personally paying his wages at Palace

3) The Forest owner is mandated to address the Palace fans pre kick off at Selhurst with a grovelling apology and a commitment to pull no such stunts in the future.

If not we send Luca Brasi round.

Yep farcical as blind trust IMO doesn’t suit football. As Simon Jordan has pointed out, if Forest needed money whilst in the trust who will they turn to ? The big Greek

What though if they owe their status, income and loyalty to the shareholder? What if, for instance, they were also his bodyguards?

Would that still be ok? Or would it just be a legal sleight of hand to get around an inconvenient rule?

I think the point is that trustees are not supposed to be ‘independent’ and legally they must act in the best interest of the beneficiaries of the trust (that’d be Textor) so yes the blind trust requirement is really just a facade - as we see at Forest!
 
Villa fan here (yes I know, yes we hate playing you 🤣) I just wanted to say how this is bollocks. I’m sorry but this is another case of UEFA ruining football. Absolutely pathetic, especially considering other clubs have been allowed to play in European competitions at the same time as other clubs they own. Pathetic and I’m so sorry for you.

Unfortunately imo he has bribed his way into the heads ( pockets) of some very influential people within UEFA.

Yes he’s an absolute moron and some of the dodgy deals he seems to have going on should be a concern, looks like (if I’m right) him buying players from the Brazilian club ended up helping Lyon which then helped his Forest team get Europa, insane and sounds so corrupt. I hope you get back in the Europa, if not, I hope you win the conference.
