Palace potentially denied entry to Europa League?


I looked at this page the other day, and I know it was the same one as I just accessed it through my internet history.

Palace were definitely on it 2 or 3 days ago.

I’m trying not to get too excited about it as there might be some other explanation about it.

I wonder where this leaves Drogheda? The CAS judgement on them appeared to be based on the March 1st deadline.

If Drogheda now need to be readmitted if the deadline was set in stone, as I hope they will be, this could be a right mess.

Their issue is that they have one owner that hasn't done anything with the shares though. Totally different case. But yeah, MCOs, just ban them, but they can't because the Arabs got in there along with the bribery to Blatter.
 
UEFA states, “… the club must prove as at 1st March … multi-club ownership criteria were met.” This document, and all other documents of this nature are sent to the club secretary, which is what the FA did when they forwarded this document to all club secretaries.

The club secretary personifies the legal status of the club. They are deemed the legal representative of the club, and their role, in this respect, is as follows: “The secretary ensures the club adheres to regulations, manages paperwork, and facilitates communication, playing a vital role in the club's overall success.”

In other words, it is their ultimate responsibility to ensure that the club is compliant with all rules and regulations. The club secretary would already be fully familiar with the MCO issues at Palace, and would have deemed the club, its directors, and all legal entities to be fully compliant with these regulations.

Regulation 5.01 a i-iv applies to a club that has a complete MCO relationship with another club. This would mean full incorporation and joint ownership of two or more clubs by one or more individuals. This did not apply to John Textor.

Relegation 5.01 b applies to an individual simultaneously managing, administering or is involved in the sporting performance of two or more clubs. This did not apply to John Textor. Steve Parish is the CEO.

Regulation 5.01 c i-iv applies to an individual or legal entity. None of these regulations applied to John Textor.

At no point does this circular stipulate that UEFA expect a reply from all club secretaries, outlining the legal status of their club in regard to these regulations. It merely requires that the club is compliant from the 1st March onwards. Whereas non compliance, of course, would mean entering into a blind trust.

If the CAS does not find in our favour, they would have to provide detailed legal argument as to why that is. It would be inconceivable that they could fly in the face of such incontrovertible facts without having very good reason to do so.

And the reason why the date was changed to the 1st March was so that UEFA could undertake detailed checks on all MCOs well before the tournaments start.

“This change was deemed necessary considering the complexity of the cases investigated by the Club Financial Control Body (CFCB), which is charged with dealing with multi-club ownership issues. The newly approved assessment date is intended to provide sufficient time for completion of the decision-making process and ensure the smooth running of UEFA’s club competitions.”

But this begs the question: What is that ‘decision-making process’? What was the CFCB actually doing from the 1st March onwards? They will have to be held accountable for that.

5.01 To ensure the integrity of the UEFA club competitions, the club must prove that as at 1 March preceding the competition season the below multi-club ownership criteria were met and the club must continue to comply with the below criteria from such date until the end of the competition season:

a. No club participating in a UEFA club competition may, either directly or indirectly:

i. hold or deal in the securities or shares of any other club participating in a UEFA club competition;

ii. be a member of any other club participating in a UEFA club competition;

iii. be involved in any capacity whatsoever in the management, administration and/or sporting performance of any other club participating in a UEFA club competition; or

iv. have any power whatsoever in the management, administration and/or sporting performance of any other club participating in a UEFA club competition.

b. No one may simultaneously be involved, either directly or indirectly, in any capacity whatsoever in the management, administration and/or sporting performance of more than one club participating in a UEFA club competition.

c. No individual or legal entity may have control or influence over more than one club participating in a UEFA club competition, such control or influence being defined in this context as:

i. holding a majority of the shareholders’ voting rights;

ii. having the right to appoint or remove a majority of the members of the administrative, management or supervisory body of the club;

iii. being a shareholder and alone controlling a majority of the shareholders’ voting rights pursuant to an agreement entered into with other shareholders of the club; or

iv. being able to exercise by any means a decisive influence in the decision-making of the club.

how true the communication is im not sure , love it tobe but until the media start having it all over the news , even then there might be something in it , and if there is people need to resign there position in UEFA
