Judges & the ECHR

Too many times now, we hear about ludicrous rulings by some of theses Liberal Left Wing Judges.
They use the ECHR card and let some terrible things happen.
Here is a really bad one that will stop Met Officers and all Met staff being kicked out by a new vetting system - MSN.
Assuming that I heard it right this morning, the man in question had committed a litany of "alleged" offences including rape.
Yet to assess and sack him would go against his human rights.
This is just nuts - we want the Police to root out the bad ones and yet this Judge has decided to stop it happening.

Yesterdays (that's when I heard about them) "judiciary offences" -
The convicted Pakistani paedophile, who is not allowed to live with his children because of his offences, cannot be deported because of his right to a family life - hmm - really - he has not been deported - the Judge therefore values the rights of a paedophile above those of the the pre-pubescent girls that he tried to have sex with - ECHR.
The Colombian criminal who - amongst other reasons - stated that he couldn't return to his native country because his Son didn't like the chicken nuggets there - he has not been deported - ECHR.
The Grenadian Lady and her son who came her in 2018 on a 6 month visa - still here today - married a Latvian but she can't go home because her new husband won't like the food or the sun - she stays - ECHR.
I might add for the sake of transparency - I think that I have got the facts right, as I heard them - TALK TV - that well know bastion of the left 🙂

Alcoholic Polish national with 9 convictions, including a restraining order for domestic violence will not be deported because it may cause his nephew hardship! I kid you not, the sooner these judges are kicked out the better

How many Judges have you had to deal with?

I have faced a few at various times in my life. Only once, I hasten to add, as the defendant. I have never sensed any kind of political bias from any of them, either right or left. Their sole motivation being to the law and ensuring it was correctly applied.

The law frequently being, of course, an ass. They quite possibly are as uncomfortable as you in having to make some of their determinations. But you are firing at the wrong targets. Judges don’t make the laws. They only interpret them. Politicians make the laws. We choose our politicians.

And what stops judges from interpreting any new laws as they see fit?

Politicians try hard to avoid ambiguity in law making. It’s why the drafting process is long and subject to such scrutiny so there ought not be a lot of room for interpretation of the intention of the law makers.

Should there be any doubt they will doubtless rely on their experience, and that of any senior colleagues they might consult, alongside examples of how similar dilemmas were previously resolved.

But that situation was the same when these laws were decided and there is plenty of scope for interpretation.

What laws are you referring to?

Any law that ends up being interpreted by Judges in ways not intended by the law makers is bad law and clarification needs to given via amendments. As will happen in the case of those claiming that “silently praying “ in exclusion areas is not intimidation and therefore remains lawful. Clever lawyers are always looking for ways to exploit potential opportunities in various conflicting clauses.

Any that allow wrong doers to stay in the country because of how a judge interprets them.

At this stage, it now goes beyond any kind of legalities. This is about rubbing our faces in the fact that they just can.

We need an entirely new judiciary. This current farce has no legitimacy. End of story.
