Palace potentially denied entry to Europa League?

This is (part of) Article 5.01, direct from the UEFA website.

Is this not saying that a person cannot even hold any shares of another club in the same competition? If so, we are clearly in breach aren't we? Or, at least were on March 1st!

Those rules are absolutely shocking and not fit for purpose.

I could hold a single £1 share in two clubs and one would thereby be eliminated.

Based on strict interpretation, EUFA MUST chuck us out.

I am hoping the appeals tribunal have a wider remit and can look to purpose of the rules, current position and so on.
 
If the rules of article 5 mean if any if a, b or c are true then we have no grounds for an appeal. And won't even get in the Conference due to the same issue with Bronby. However if all 3 have to be true fir article 5 to apply then we have a case to appeal that Textor did not have decisive control. Not a lawyer so dont know.
I actually write legal terms and conditions for a financial company for a living. Well, I transpose them into computer code, I don't do the legal bit, but I read a lot. We'd expect our customers to infer that if ANY of those were true then they'd fall foul of the rules, if they were terms in our documentation.

However, in many ways you'd think that would increase our chances of finding precedent where these rules hadn't been applied.
 
Hmm, it is between us and a similar sized club.

If our demotion/expulsion meant Man Utd taking our place, I suspect we would be on page 500 by now (and the BBC would have long abandoned any pretense of neutrality).

I guess this would mean our only argument would be the ridiculous March 1st deadline.

What I don't understand though, is where did this suggestion of there having to be 'decisive influence' come from?
 
I've followed this thread closely until three days ago when work stuff had to take a front seat. Can anyone update me in a few sentences on anything thats happened last 48 hrs to save me trawling through 20 odd pages?

Textor said UEFA shouldn't be ascertaining whether he had 43% or 25% influence because he had 0% which makes me think they were looking at decisive influence. But in the snippet shared above, 'decisive' doesn't seem relevant.
 
No worries, I wasn't being sarcastic. Been decorating all day and wasn't sure what I had missed. Hope it is today.
I think UEFA have been doing something else today. Maybe not having the painters in, but perhaps painting the town red on expenses. That cash in the brown envelops won't spend itself 🙂

I would hope the fact that Lyon and Palace no longer has any legal entity that has any executive position, owns shares or has any other control or influence of any sort in both clubs might be relevant.

(I am aware the fly in the ointment remains completion of the asset transfer to Johnson)
