Lawfare.....not Warfare. But still nasty.....

a relatively new expression. Coming to the fore in World Politics. A good example being Trump and Biden. Both using and abusing the Law in equal measure. Using the Law to score points, to play one-upmanship. And generally to be nasty and disagreeable. Granting pardons to their buddies and being as vitriolic and petty as possible to their enemies.

Instead of chucking spears at each other, its people chucking toxic documents about. And the precedent is fairly old.......

- Thomas a-Beckett used canon law, eccesiastical law to excommunicate & anathamise the knights sent to murder him in the Cathedral.

- The Death of Stalin movie, has a wonderful scene of a Soviet Kangaroo Court in action. The paperwork starts before the petrol canister is opened.

The idea that 'the Law' is neutral, immutable, and as blindfolded & balanced as the scales held by the lady in the statue.......a wonderful fantasy. Up there with Charlie and the chocolate factory.

What instances of Lawfare come to mind ? Lets hear of your favourite examples of the Law being completely ridiculous & biased. Compare and contrast to good old fashioned Justice.

Vardy v Rooney a complete and utter bore.Who gave a 4X.Simply too much money in the hands of nasty vengeful middle aged women.

Lawfare is a term that is deliberately misused, especially by those trying to suggest that Trump was unreasonably targeted. It nothing to do with any abuse of pardons, which are the domain of Presidents and not the legal system which decides guilt on the facts, not on political prejudice.

Trump and Le Pen have been found guilty by Courts whose duty is to the law and only the law. The idea that there is political influence in the judicial system in any western country is absurd. In Russia and the third world it isn’t, it happens.

Or even Sinn Fein/IRA .
I don't advocate barring people from politics, particularly on legal action that seems politically motivated. Punish her for her crime and get the money back, but you would think the electorate would automatically swerve her at the Ballot Box.

We have a thief as Chancellor, and no-one seems to be able to jail her. 🙂
 
That is a shameful headline which isn’t born out by the report below it.

Judges are people and part of society. Like the rest of us they are influenced by their upbringing and history. Some of us remain unconsciously biased in our attitudes, despite our best efforts not to be.

That’s all that’s being demonstrated here. There may be appeals due to unfair treatment because of any number of prejudices. Rarely one would hope but that so many have witnessed at least one incident is hardly surprising is it? There are many Judges and thousands of incidents. In own lives we will have witnessed one. It’s a non story and certainly does not suggest there is institutional racism which indicates it’s to be found regularly and everywhere.

She hasn’t been barred from politics!

She has been found guilty by a Court and punished by a Judge. That punishment includes not being able to run herself for public office. Not that she cannot advocate for others or serve them in a non executive function.

I wish the same punishment had been applied in the USA.

She did the crime. Which apparently was on a very large scale.

She is not above the law.

She has been given what the Judge decided was an appropriate punishment.

I am not conversant with French law on whether those convicted of political fraud are entitled to run for President? Is anyone else here, or are they just being their usual know it all expert.
 
That’s 7 years old and doesn’t suggest there is institutional judicial racism, only that some defendants are disadvantaged by the way we, as a society, regard them.

Some of her political opponents have said banning her from running for President is a terrible idea. Perhaps they realise that making her a victim is not a great idea. I guess that makes them smarter than the Democrats.

What I find laughable is that this concerns dodgy dealings with EU money. Considering that the EU is awash with corruption I would be amazed if other parties aren't up to similar things, her crime is she got caught.

And then we have French domestic politics hardly a beacon for honesty.

No, the French judiciary is independent she was found guilty of the crime and she knew she would be.

However it may look politically, emotionally, she would have to disprove the facts on appeal.

Looking at the press today, none of them are actually disputing what happened.

Ad you didn't read what I said. I am not denying her guilt but like I said even her opponents are saying banning her from running is too much.

No, it means that although the perception of both her and Trump being seen as victims was just as obvious to the Democrats as it is to them, they are prepared to intervene politically by speaking out. The Democrats were not. They knew full well that sitting back and watching justice take its slow and tortuous course would hurt them but to intervene would see them guilty of that which Trump was accused of. So they accepted the hit.
